LINCOLN, NE — Today, Allie Berry, Campaign Manager of Protect Our Rights, Initiative 439 on the ballot, issued the following statement:
“Lies, lies, and more lies. That’s the story of Initiative 434, also known as the Protect Women & Children. Today, we reluctantly filed a Cease & Desist letter to stop their irresponsible misinformation campaign that’s running in the state. During the petition process, Protect Women & Children misrepresented their measure to Nebraska voters and, as a result, received a record number of complaints to the Secretary of State. Now, with funding from Sen. Pete Ricketts, the Peed family, and allies, they are spending hundreds of thousands of dollars on advertising that’s full of false statements about our measure to confuse voters and maintain political power over our private healthcare decisions. Any stations and platforms that run their ad are complicit in spreading the lies. in the misinformation campaign. Initiative 434’s ads are not only lies and misleading; they are potentially harmful to women’s health.
Nebraskans must know the truth; under the current abortion ban and law, doctors are forced to delay or deny needed care to patients. The ban has had a devastating impact on women, forcing some to carry pregnancies that will not survive, and others are left with few options other than to have a stillbirth, flee the state, or wait for life-threatening conditions like sepsis, organ failure, or bleeding out before doctors can intervene. However, Nebraskans end the current abortion ban and stop political interference by voting against Initiative 434 and voting for Initiative 439.”

Initiative 439 will end the current abortion ban that was forced into law by state lawmakers in 2023.
Initiative 439 will stop political interference in reproductive healthcare decisions.
Under no circumstances will Initiative 439 limit licensed physicians from providing medical care to women in crisis.
Initiative 439 puts women and families back in charge of personal healthcare decisions.
Initiative 439 protects critical patient/healthcare provider relationships by requiring an individual’s “treating healthcare practitioner” – which includes licensed physicians – to determine the fetal viability of a fetus.
